Structural problems are examined with pairing two chambers, one selected by election and the other by sortition, into a traditional bicameral system. It is argued that an all-purpose legislative chamber modeled on existing elected chambers is a mismatch for sortition and that purported benefits of maintaining partisan elections alongside sortition are illusory. Alleged benefits of a hybrid bicameral system are shown to be outweighed by a variety of harmful effects. Furthermore, even if those harms are not substantiated, the continued existence (...) of an elected chamber will likely result in the delimitation of the sortition chamber. Combining many different sorts of minipublics with different characteristics and functions is preferable, and a possible multibody sortition legislative system is presented. Finally, an alternative way forward for sortition is proposed by peeling away individual topic areas from elected bodies and transferring them to sortition bodies. (shrink)

The political theory of the property-owning democracy can be seen as a way of overcoming the ideological conflict between individualism and collectivism. Rawls offers the contemporary reference-point for this theory. Rawls contrasted the ideal-type of the property-owning democracy with the ideal-type of a capitalist welfare state. However, the terms of that contrast are not well drawn and raise a number of questions, in particular regarding Rawls’s a priori specification of the welfare state. An inductively derived specification of ideal-typical welfare states (...) suggests that horizontal redistribution, in line with the principle of social savings, is more important than vertical redistribution. Rawls’s preference for a social dividend or negative income tax scheme can be contrasted with the use of social insurance, but the latter has a claim to instantiate Rawlsian ideals better than a social dividend. There is a potential problem with the pre-emption of private savings in the welfare state, but this turns out not to be troublesome empirically or conceptually. The irony of the discussion is that those who have interpreted Rawlsian theory as justifying the welfare state have the better of the argument, despite Rawls’s own views. (shrink)

Part 1 of this article, which appeared in the first installment of the Common Knowledge symposium “Antipolitics,” presented reasons why elections are an inappropriate method for selecting representatives in a democracy. Part 2, published in the symposium's second installment, offers arguments for why sortition — the selection of shorter-duration representatives by lottery from the general population — is the best procedure for democracy. Random selection can assure broad diversity and descriptive representation, and it allows those people selected to overcome the (...) rational ignorance that plagues elections. Concerns about the competence of ordinary people who are randomly selected are addressed. The issues of corruption and policy accountability are examined to show that elections cannot provide the genuine accountability ensured by random selection. Some specific design considerations for an optimal sortition-based democracy are also presented. (shrink)

In the last two decades, there has been a blossoming literature aiming to counter the neglect of plant capacities. In their recent paper, Miguel Segundo-Ortin and Paco Calvo begin by providing an overview of the literature to then question the mistaken assumptions that led to plants being immediately rejected as candidates for sentience. However, it appears that many responses to their arguments are based on the implicit conviction that because animals have far more sophisticated cognition and agency than plants, and (...) that plants should not have the same moral status as animals, plants should not have any moral status. Put in simpler terms: it is not as bad to eat plants than to eat, say, pigs. While there are still uncertainties around comparative moral and policy implications between animals and plants, given a gradualist account of quasi-sentience and partial moral status, both of which we claim are a matter of degree, we may not have to abolish our convictions by declaring that plants have no sentience or moral status at all. Indeed, we can hold two things at the same time: that animals and plants have moral status, but animals have prima facie more moral status than plants. (shrink)

We investigate the value of persons. Our primary goal is to chart a path from equal and extreme value to infinite value. We advance two arguments. Each argument offers a reason to think that equal and extreme value are best accounted for if we are infinitely valuable. We then raise some difficult but fruitful questions about the possible grounds or sources of our infinite value, if we indeed have such value.

Most authors who work with moral status automatically dismiss the possibility that plants are the kinds of entities that have moral status. This dismissal coheres with our intuitions about common-sense morality: if plants do not have moral status then we do not have any direct moral obligations to plant life. An implication of such a view is that any suggestion otherwise commits one to be in favour of an absurd conclusion. However, given the recent literature and empirical evidence on plant (...) minds, there are reasons to accept a different perspective that finds the absurd conclusion plausible. (shrink)

The community has legislatively conferred on external auditors a special but lucrative responsibility to provide fair and independent opinions about management''s preparation of company financial statements. In return, auditors are obliged by professional standards to act with integrity, independently and in the public interest. This study examined 174 auditors'' predisposition to provide just and fair judgements, using Kohlberg''s theory of developmental moral reasoning, one of the most widely accepted theories in justice psychology. Respondents came from five international audit firms in (...) Copenhagen. Results indicated that auditors with pre-conventional or low level of just reasoning or comprised 64 respondents, the largest group in the sample. The pre-conventional level suggests that people will act in their own self-interest and do the right only to avoid punishment. Pre-conventional auditors have the ability to "do deals", advantageous for business. When faced with an ethical crisis, however, auditors as this level will tend to focus on their own needs at the expense of others. The post-conventional or mid level of just reasoning comprised 59 auditors, second largest group in the sample. This level indicates that these auditors have the predisposition to act fairly on principal, particularly when faced with an ethical crisis. The conventional level or mid-just reasoning consisted of 51 auditors. People with a conventional level of just reasoning believe in law and order, the maintenance of the status quo, however they tend not to be critical of laws, nor authority even if those laws and authority are unjust or evil. This paper argues that Foucault’s genealogy of racism deserves appreciation due to the highly original concept of racism as biopolitical government. Modern racism, according to Foucault, is not merely an irrational prejudice, a form of socio-political discrimination, or an ideological motive in a political doctrine; rather, it is a form of government that is designed to manage a population. The paper seeks to advance this argument by reconstructing Foucault’s unfinished project of a genealogy of racism. Initially, the paper situates the (...) genealogy of racism within the context of Foucault’s work. It belongs to a period of transition between the mature and the late part of Foucault’s work, more specifically a period of transition from discipline to governmentality. The paper proceeds by reading closely key passages from the 1976 lectures at Collège de France in which Foucault proposes to rethink racism as a form of biopolitical government. While Foucault’s genealogy of racism remains an incomplete project, lacking for example any substantial treatment of European colonialism, the paper proposes to expand the Foucauldian analysis by linking it to the pan-German discourse between 1890 and 1914. Finally, the paper reflects on some of the implications of the Foucauldian analysis, in particular attempts to understand and counter contemporary forms of racism. Foucault’s genealogy of racism, in short, shows us the constructedness of our racialized world and challenges us to develop new and more effective strategies to change it. (shrink)

How veridical is perception? Rather than representing objects as they actually exist in the world, might perception instead represent objects only in terms of the utility they offer to an observer? Previous work employed evolutionary modeling to show that under certain assumptions, natural selection favors such “strict‐interface” perceptual systems. This view has fueled considerable debate, but we think that discussions so far have failed to consider the implications of two critical aspects of perception. First, while existing models have explored single (...) utility functions, perception will often serve multiple largely independent goals. (Sometimes when looking at a stick you want to know how appropriate it would be as kindling for a campfire, and other times you want to know how appropriate it would be as a weapon for self‐defense.) Second, perception often operates in an inflexible, automatic manner—proving “impenetrable” to shifting higher‐level goals. (When your goal shifts from “burning” to “fighting,” your visual experience does not dramatically transform.) These two points have important implications for the veridicality of perception. In particular, as the need for flexible goals increases, inflexible perceptual systems must become more veridical. We support this position by providing evidence from evolutionary simulations that as the number of independent utility functions increases, the distinction between “interface” and “veridical” perceptual systems dissolves. Although natural selection evaluates perceptual systems only on their fitness, the most fit perceptual systems may nevertheless represent the world as it is. (shrink)

This article focus on paradigms, methods and ethics of action research in the Scandinavian countries. The specific features of the action research paradigm are identified. a historical overview follows of some main action research projects in Norway, Sweden and Denmark. The tendency towards upscale action research projects from organisational or small community projects to large-scale, regional based network approaches are also outlined and discussed. Finally, a synthesised approach of the classical, socio-technical action research approach and the large-scale network and holistic (...) approaches is suggested as a promising approach for the future. In National Responsibility and Global Justice, David Miller defends the view that a member of a nation can be collectively responsible for an outcome despite the fact that: (i) she did not control it; (ii) she actively opposed those of her nation’s policies that produced the outcome; and (iii) actively opposing the relevant policy was costly for her. I argue that Miller’s arguments in favor of this strong externalist view about responsibility and control are insufficient. In this essay I consider the normative implications of the notion of reasonability for the construction of an idea of public reason that is cosmopolitan in scope. First, I consider the argument for the distinction between reason and reasonability in the work of Sibley and Rawls. Second, I evaluate the normative implications of reasonability through a consideration of Korsgaard's recent work. Third, I argue for a notion of reasonability that moves us beyond a Kantian concept of autonomy through a consideration (...) of the relationship between reasonability and judgment vis-à-vis Arendt's work on Kant's Third Critique. Finally, I argue for a cosmopolitan appropriation of the notion of reasonability based on Kant's notion of the aesthetic idea. The latter argument relaxes the bonds of public reason, moving us beyond the domain of ethnocentricism. (shrink)

It is impermissible to violate a constraint, even if by doing so a greater number of violations of the very same constraint were to be prevented. Most find this puzzling. But what makes the impermissibility of such minimizing violations puzzling? This article discusses some recent answers to this question. The article's first aim is to make clear in what way these answers differ. The second aim is to evaluate the answers, along with Kamm's and Nagel's proposed solutions of what they (...) see as the puzzle of constraints. The main thesis of the article is this: because defenders of constraints are not committed to any conception of valuable states of affairs, constraints do not conflict with maximizing rationality; but neither can they be accounted for in terms of impersonal values. Scenarios are flexible means to integrate disparate ideas, thoughts and feelings into holistic images, providing the context and meaning of possible futures. The application of narrative scenarios in engineering, development of socio-technical systems or communities provides an important link between general ideas and specification of technical system requirements. They focus on how people use systems through context-related storytelling rather than abstract descriptions of requirements. The quality of scenarios depends on relevant assumptions and authentic scenario stories. In this article, we will (...) explore how the narrative approach may enrich the scenario ‘skeleton’ with ‘flesh and blood’, that is, living, detailed and consistent storytelling. Against arguments that suggest that Rawls’s notion of reasonability is ‘obscure’ and ‘unclear’ I argue in this essay that the idea of reasonability in the later Rawls can be defended in three ways. First, it can be shown that reasonability is fundamental to the architectonic of the later work. Reasonability, and the subordination of reason to reasonability, is fundamental to the later (post-1980) writings. Second, it can be shown that reasonability is not necessarily a vague term as many have claimed. (...) Third, it can be shown that reasonability is fundamental to what Rawls calls the three major new ideas of Political Liberalism: overlapping consensus; the reconception of the priority of the right over the good; and the idea of public reason. The ‘buck-passing’ account equates the value of an object with the existence of reasons to favour it. As we argued in an earlier paper, this analysis faces the ‘wrong kind of reasons’ problem: there may be reasons for pro-attitudes towards worthless objects, in particular if it is the pro-attitudes, rather than their objects, that are valuable. Jonas Olson has recently suggested how to resolve this difficulty: a reason to favour an object is of the right kind only if its formulation (...) does not involve any reference to the attitudes for which it provides a reason. We argue that despite its merits, Olson's solution is unsatisfactory. We go on to suggest that the buck-passing account might be acceptable even if the problem in question turns out to be insoluble.
